These terms (the "Terms") govern your use of the Zaai Dev platform — the workspace at zaaistudio.com/dev, the API surface, the sibling MCP server, and any related services provided by Zaai Studio (Pty) Ltd ("Zaai", "we", "us"). By creating an account or using the service you accept these Terms.
1. The service
Zaai Dev is a workspace for designers and agencies to capture design references, run a brand-brief intake, generate a brand brief, and serve that brief to AI tools over a standard MCP contract.
We provide the service on an "as is" and "as available" basis. We work hard to keep uptime high — our public status page is linked from the footer — but we don't guarantee uninterrupted access.
2. Your account
You're responsible for the security of your account credentials, for any API or MCP tokens you issue, and for the activity that happens under your account. If you spot suspicious activity, let us know at support@zaaistudio.com.
3. Acceptable use
You agree not to:
- Use Zaai Dev to capture or store content you don't have the right to capture.
- Reverse-engineer the service, bypass rate limits, or attempt to extract credentials from the platform.
- Use Zaai Dev to generate content that's illegal, defamatory, or that violates the rights of third parties.
- Resell or sublicense access to Zaai Dev without a written partnership agreement.
4. Credits and payment
Most actions in Zaai Dev consume credits. Free accounts receive a monthly grant; the Dev subscription adds a larger monthly grant; top-up credits never expire.
- Subscription credits reset to your tier grant on the first of each calendar month (UTC). Unused subscription credits don't carry over.
- Top-up credits never expire while your account is active.
- Refunds for top-ups are available within 14 days of purchase if zero of the credits in that pack have been consumed.
- Subscriptions can be cancelled any time from the Stripe customer portal; access remains until the end of the paid period.
Prices are listed in USD and ZAR on our pricing page. Stripe calculates and adds any applicable taxes; the invoice from Stripe is the authoritative record of what you paid.
5. Your content
You retain ownership of every capture, brief, decision, and project you create in Zaai Dev. By using the service you grant us a limited licence to store, process, and serve that content on your behalf — including sending it to our AI providers when you ask us to generate, classify, or embed.
We don't use your content to train our own models, and our AI providers don't train on data submitted via their paid APIs.
6. AI output
Brand briefs, classifications, and other AI-generated content are derived from your inputs. They're a useful starting point, not a guarantee of accuracy. Review AI output before relying on it for client work.
7. Termination
You can delete your account at any time from /dev/settings; we'll permanently remove your workspace data 90 days after cancellation (see the privacy policy for details). We can suspend or terminate accounts that breach these Terms with reasonable notice, and immediately in cases of fraud, abuse, or legal compulsion.
8. Liability
To the maximum extent permitted by law, Zaai is not liable for indirect, incidental, or consequential damages arising out of your use of the service. Our total liability in any 12-month period is capped at the fees you paid us during that period.
9. Governing law
These Terms are governed by the laws of the Republic of South Africa. Disputes that can't be resolved by talking go to the courts of the Western Cape.
10. Changes
We'll email account owners and update the "last updated" date above before any material change to these Terms takes effect.
